1. Agreement and eligibility
These Terms of Service (the “Terms”) are a binding agreement between you and SellerCommand (“SellerCommand,” “we,” “us,” or “our”) governing your access to sellercommand.app and its related applications and services (collectively, the “Service”).
By creating an account, connecting an eBay account, starting a trial or subscription, or otherwise using the Service, you agree to these Terms and our Privacy Policy. You must be at least 18 years old and legally able to enter a contract. If you use the Service for a business or other organization, you represent that you have authority to bind it.
2. What SellerCommand provides
SellerCommand is a seller operations and analytics tool. It can import information from an eBay account you authorize, organize listings and inventory, reconcile available order and fee data, calculate profit estimates, show advertising performance, generate recommendations, create listing-work prompts, and export reports.
SellerCommand is an independent service and is not sponsored, endorsed by, or affiliated with eBay. eBay and its services are governed by eBay’s own agreements and policies.
The Service is a decision-support tool. It does not provide legal, tax, accounting, investment, or financial advice, and it does not guarantee sales, ranking, traffic, profit, or marketplace outcomes.
3. Accounts, trials, and security
You must provide accurate account information, keep your credentials secure, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account and for maintaining access to your email and connected third-party accounts.
Eligible new workspaces receive one seven-day trial without a payment card. The trial begins when an eBay account is first connected, so account setup does not consume the access window. Unless we approve otherwise in writing, trials are limited to one per person or business and may not be obtained through duplicate accounts, false identities, credential sharing, or other circumvention. When a trial ends, a paid plan is required to continue using protected workspace features.
We may refuse registration, require verification, suspend access, or close accounts reasonably connected with fraud, abuse, security risk, payment disputes, or violations of these Terms.
4. eBay connection and seller responsibilities
You authorize SellerCommand to use the eBay permissions you approve through eBay OAuth to retrieve and process data for your workspace. You may revoke that authorization through eBay. Revocation can prevent future syncs without immediately removing information previously imported into SellerCommand.
You remain solely responsible for your listings, product claims, prices, inventory, promoted listing settings, campaigns, buyer communications, taxes, shipping, returns, refunds, regulatory obligations, and compliance with eBay policies and applicable law. You must review recommendations and generated text before acting on or publishing them.
eBay APIs may omit, delay, aggregate, revise, or restrict data. SellerCommand labels unavailable or estimated inputs where practical, but you must verify material financial and marketplace decisions against your eBay records and professional advisers.
5. Your content and data
You retain ownership of information and content you submit or connect to the Service. You grant us a limited, worldwide, non-exclusive license to host, copy, process, transmit, display, and create technical or analytical transformations of that content only as needed to operate, secure, support, and improve the Service and comply with law.
You represent that you have the rights and permissions necessary to provide that content. Do not submit sensitive personal information that the Service does not request, unlawful content, another person’s confidential information, or content that infringes intellectual property or privacy rights.
Aggregated or de-identified information that cannot reasonably identify you or your business may be used to operate, secure, analyze, and improve the Service.
6. Prompt Studio and generated material
Prompt Studio creates structured text based on selected listing facts. Generated material may be incomplete, inaccurate, similar to other content, or unsuitable for a particular product or marketplace rule. It is not a substitute for inspecting the item or verifying brand, condition, compatibility, dimensions, safety information, intellectual-property rights, or required disclosures.
You are responsible for reviewing and editing every output before use. We do not promise that generated material is unique, non-infringing, or accepted by eBay or any other platform.
7. Subscriptions, renewal, and cancellation
Paid plans are recurring subscriptions billed through Stripe at the price, currency, interval, and taxes shown at checkout. By subscribing, you authorize Stripe and SellerCommand to charge the selected payment method at the start of each billing period until cancellation. Plan features and usage limits, including Prompt Studio capacity, are described on the Pricing page and at checkout.
You may cancel and manage payment methods through the Stripe customer portal available in account settings. Unless the checkout terms state otherwise, cancellation takes effect at the end of the current paid billing period and does not create a prorated refund. Fees are non-refundable except where required by law or expressly agreed by us in writing.
Failed, reversed, or disputed payments may result in suspension or termination of paid access. You are responsible for applicable taxes and accurate billing information. We may change future prices or plan features with advance notice when required by law; changes apply no earlier than your next renewal after the notice period.
8. Acceptable use
You may not use the Service to violate law or third-party rights; misrepresent products; facilitate fraud; transmit malware; probe or bypass security; scrape or access the Service through unauthorized automation; overload infrastructure; evade plan limits or access controls; reverse engineer the Service except where law expressly permits it; resell access without permission; or use another person’s account, credentials, or marketplace data without authorization.
You may not use SellerCommand to interfere with eBay, manipulate marketplace systems, or perform conduct prohibited by eBay’s policies. We may investigate suspected abuse and cooperate with lawful requests.
9. Third-party services
The Service depends on third parties including eBay, Stripe, Google, Railway, Resend, Sentry, and analytics or advertising providers you permit. Their services and terms are outside our control. We are not responsible for third-party outages, policy changes, account actions, data accuracy, fees, or security practices.
Links to third-party sites are provided for convenience and do not imply endorsement. Your use of those services is governed by their terms and privacy policies.
10. Changes, availability, and termination
We may modify, add, suspend, or discontinue features to maintain security, comply with law or third-party requirements, or improve the Service. We do not guarantee uninterrupted or error-free operation, permanent retention of imported data, or continued availability of any eBay endpoint or data field.
You may stop using the Service at any time. We may suspend or terminate access for a material breach, nonpayment, security threat, unlawful conduct, or risk to users, third parties, or the Service. Provisions that by their nature should survive termination will survive, including ownership, payment obligations, disclaimers, liability limits, and dispute terms.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” SELLERCOMMAND DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RESULTS.
Financial figures are operational estimates based on imported and seller-entered information. Missing source cost, fees, refunds, shipping labels, tax treatment, timing differences, currency conversion, or eBay reporting changes can materially affect results. You are responsible for maintaining official accounting and tax records.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SELLERCOMMAND AND ITS OWNERS, AFFILIATES, PERSONNEL, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES; OR MARKETPLACE SUSPENSION OR ACCOUNT ACTION, EVEN IF ADVISED OF THE POSSIBILITY.
Our total aggregate liability arising from or related to the Service will not exceed the greater of (a) the amount you paid SellerCommand for the Service during the 12 months before the event giving rise to the claim or (b) US $100. These limits do not apply where liability cannot lawfully be limited.
13. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless SellerCommand and its owners, affiliates, and personnel from third-party claims, damages, losses, liabilities, and reasonable costs arising from your content, listings, products, marketplace activity, violation of these Terms, or infringement of another person’s rights. We may control the defense of a covered claim, and you agree to cooperate.
14. Governing law and disputes
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Before filing a claim, each party agrees to send written notice describing the dispute and requested resolution and to attempt in good faith to resolve it for 30 days.
Unless applicable law requires otherwise, disputes must be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and each party consents to their jurisdiction. Nothing here limits rights that cannot be waived under applicable consumer law.
15. General terms
These Terms and incorporated policies are the entire agreement regarding the Service. If a provision is unenforceable, it will be modified only as needed and the remainder will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or sale of assets.
We may update these Terms. We will post the revised version and update the effective date, and will provide additional notice of material changes when required. Continued use after the effective date means you accept the revised Terms.
